Pawsitively K9 - Wellness/Vaccination Policy - ALL SERVICES

We have set high standards here at Pawsitively K9 and we have implemented strict health & safety requirements for a very good reason – we are committed to keeping all pets safe and healthy! If we failed to require protection against contagious diseases and parasites, we could not promise your pet the safest environment possible. Accordingly, all pets visiting must be current on the routine preventative health care for contagious diseases. To insure adequate protection, vaccinations & parasite testing procedures must be provided by a licensed veterinarian (hard-copy documentation required). Thank you in advance for helping us keep all of our PawsitivelyK9 companions healthy and safe!

Vaccination Requirements: Pawsitively K9 requires Rabies (Annually or 3 yr).  You must present the Rabies certificate-this is what the Rabies tag is usually attached to), DHPP (Distemper, Hepatitis, Parainfluenza, Parvovirus)-Annually, and Bordetella-Annually.

For your pets safety and well-being, please allow a minimum of forty eight (48) hours after receiving vaccinations such as Distemper and/or Rabies prior to arrival.

PLEASE NOTE: If the Bordetella vaccine has never been given, has expired, or was given via: intranasal (drops in the nose), the vaccine must be administered at least FOURTEEN (14) DAYS PRIOR to arrival. If the Bordetella vaccine is boostered a minimum of FIVE (5) DAYS is required before visiting.

PUPPIES are required to have their second set of DHPP, Bordetella vaccinations, and are required to have their Rabies vaccination (at 12-16 weeks of age).

We can also vaccinate boosters of Bordetella or DHPP for your K9 in the situation when you are not able to get this from your vet prior to their stay.  We will require you to sign a waiver at the time of drop off and can administer the vaccines as soon as they arrive.

WE CANNOT ADMINISTER RABIES THIS IS STATE LAW-RABIES MUST BE DONE BY A LICENSED VETERINARIAN.

Bottom Line...we want your K9 to be safe healthy and happy.

PAWSITIVELY K9 LIABILITY WAIVER

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.
I voluntarily enroll myself and/or my dog(s) in training, behavior modification, evaluations, consultations, private lessons, group classes, public outings, or other training-related services provided by Pawsitively K9 Dog Training and Behavior Modification (“Pawsitively K9”).

1. ASSUMPTION OF RISK
I understand that working with dogs involves inherent risks. I acknowledge that any dog, regardless of breed, age, training level, temperament, or history, may bite, scratch, jump, pull, escape, damage property, injure another animal, or cause injury to a person.
I understand that training activities may occur at Pawsitively K9 facilities, on my property, in public locations, parks, stores, sidewalks, parking lots, or other environments where unforeseen risks may exist.
I voluntarily assume all risks associated with participation in training activities.

2. OWNER REPRESENTATIONS
I certify that I am the legal owner or authorized guardian of the dog(s) participating in services.
I agree to disclose any known history of aggression, bites, attacks, reactivity, resource guarding, escape behavior, predatory behavior, or other potentially dangerous tendencies before participating in services.

3. RESPONSIBILITY FOR OTHERS
I understand that family members, guests, visitors, children, neighbors, and other individuals present during training sessions may be exposed to risks associated with dogs and dog training activities.
I accept responsibility for supervising all persons under my control and informing them of these risks.

4. TRAINING EQUIPMENT
I understand that training may involve the use of leashes, long lines, harnesses, training collars, slip leads, muzzles, crates, place boards, toys, food rewards, and other training tools.
I acknowledge and accept the risks associated with the use of training equipment.

5. RELEASE OF LIABILITYTo the fullest extent permitted by law, I release, waive, and discharge Pawsitively K9, its owners, trainers, assistants, employees, volunteers, and agents from any and all claims, demands, damages, liabilities, costs, expenses, or causes of action arising from participation in training services.
This release includes, but is not limited to, claims involving injury, illness, dog fights, bites, scratches, escapes, property damage, or other incidents involving my dog(s), myself, family members, guests, or other persons present during training activities.
6. INDEMNIFICATION

I agree to assume full responsibility for any injury, damage, loss, or expense caused by my dog(s), myself, family members, guests, or children under my supervision.
I further agree to indemnify, defend, and hold harmless Pawsitively K9, its owners, trainers, assistants, employees, volunteers, and agents from any claims, lawsuits, damages, attorney fees, costs, or liabilities arising from the actions of my dog(s), myself, family members, guests, or children under my supervision.

7. NO GUARANTEE OF RESULTS
I understand that no specific training results or behavioral outcomes have been promised or guaranteed.
I acknowledge that training success depends on many factors, including genetics, temperament, health, environment, consistency, management, and owner compliance with training recommendations.
Pawsitively K9 makes no guarantee regarding future behavior.

8. PHOTO AND VIDEO RELEASE
I grant permission for Pawsitively K9 to use photographs or videos of myself and/or my dog(s) for educational, promotional, advertising, website, and social media purposes without compensation.

9. ACKNOWLEDGEMENT
I have carefully read and understand this Liability Waiver and Release. I voluntarily agree to its terms.

PAWSITIVELY K9 BOARDING, DAYCARE, AND BOARD-AND-TRAIN SERVICE AGREEMENT AND LIABILITY WAIVER

  1. OWNER REPRESENTATIONS

Owner/Guardian certifies that all information provided regarding the dog is accurate and complete.

Owner/Guardian represents that they are the legal owner or authorized guardian of the dog and have authority to enter into this Agreement.

Owner/Guardian agrees to disclose any known history of aggression, bites, attacks, reactivity, resource guarding, escape behavior, medical conditions, behavioral concerns, or other issues that may affect the safety of the dog, staff, or other animals.

Pawsitively K9 reserves the right to refuse or terminate services at any time if a dog presents a safety risk or if information provided by the Owner/Guardian is found to be inaccurate or incomplete.

  1. HEALTH REQUIREMENTS

Owner/Guardian certifies that the dog is in good health and has not been knowingly exposed to a contagious or communicable illness within the thirty (30) days prior to check-in.

Owner/Guardian agrees to provide proof of vaccinations and any other required veterinary documentation upon request.

Owner/Guardian understands that while Pawsitively K9 makes reasonable efforts to maintain a healthy environment, exposure to communicable illnesses may occur whenever dogs are housed, exercised, trained, or socialized around other dogs.

Owner/Guardian understands that vaccinations help reduce, but do not eliminate, the risk of communicable disease and that Pawsitively K9 cannot guarantee that a dog will not become ill while participating in services.

  1. ASSUMPTION OF RISK

Owner/Guardian acknowledges that participation in boarding, daycare, training, playgroups, exercise, transportation, enrichment activities, and other services involves inherent risks.

These risks may include, but are not limited to:

• Illness or communicable disease
• Dog bites or scratches
• Dog-to-dog altercations
• Injury during play
• Injury caused by slipping, running, jumping, or roughhousing
• Exposure to environmental hazards
• Escape attempts
• Ingestion of natural or foreign objects
• Transportation-related incidents
• Stress-related illnesses or injuries

Owner/Guardian voluntarily assumes all risks associated with participation in services provided by Pawsitively K9.

  1. ENVIRONMENTAL DISCLOSURE

Owner/Guardian understands that dogs may be exposed to grass, dirt, gravel, trees, leaves, sticks, rocks, toys, pools, sprinklers, agility equipment, fencing, and other natural or man-made environmental features.

Owner/Guardian acknowledges that some dogs may be prone to digging, climbing, chewing, ingesting foreign objects, escaping, or engaging in other behaviors that increase their risk of injury.

Owner/Guardian accepts these risks and understands that no environment can be made completely risk-free.

  1. PLAYGROUPS AND SOCIALIZATION

Owner/Guardian understands that dogs may participate in supervised playgroups and social interactions with other dogs.

While reasonable precautions are taken to promote safety, Owner/Guardian understands that dog-to-dog interactions may result in scratches, nicks, bruises, punctures, bites, or other injuries.

Pawsitively K9 reserves the right to remove any dog from group activities at its sole discretion for safety reasons.

Dogs deemed unsafe for group participation may be separated from group activities, exercised individually, crated when appropriate, muzzled when appropriate, or otherwise managed at the discretion of Pawsitively K9 staff.

  1. TRAINING DURING BOARDING OR DAYCARE

Owner/Guardian understands that training, behavior modification, leash work, obedience exercises, confidence-building exercises, socialization activities, enrichment activities, handling exercises, or similar training services may occur during a dog’s stay.

Owner/Guardian acknowledges that participation in training activities involves inherent risks similar to those associated with all dog training services.

Owner/Guardian voluntarily assumes these risks.

Owner/Guardian further understands that no specific training outcome or behavioral result is guaranteed.

  1. NO GUARANTEE OF RESULTS

Pawsitively K9 makes no guarantee regarding training results, behavioral changes, socialization outcomes, or future behavior of any dog.

Training success depends on many factors including genetics, temperament, health, environment, consistency, management, and owner follow-through.

  1. RELEASE OF LIABILITY

To the fullest extent permitted by law, Owner/Guardian releases, waives, and discharges Pawsitively K9, its owners, trainers, employees, assistants, volunteers, agents, and affiliates from any and all claims, liabilities, damages, losses, expenses, or causes of action arising from participation in services.

This release includes, but is not limited to, claims involving illness, injury, bites, scratches, altercations, property damage, transportation, training activities, environmental hazards, or death.

  1. INDEMNIFICATION

Owner/Guardian agrees to assume full responsibility for any injury, damage, loss, or expense caused by their dog.

Owner/Guardian agrees to indemnify, defend, and hold harmless Pawsitively K9, its owners, trainers, employees, assistants, volunteers, agents, and affiliates from any claims, lawsuits, attorney fees, damages, or liabilities arising from the actions of the dog or from inaccurate information provided by the Owner/Guardian.

  1. EMERGENCY VETERINARY CARE

If Pawsitively K9 determines that emergency veterinary treatment is necessary, reasonable efforts will be made to contact the Owner/Guardian and emergency contact.

If contact cannot be made, Owner/Guardian authorizes Pawsitively K9 to obtain veterinary care deemed necessary for the dog’s health and safety.

Owner/Guardian agrees to be financially responsible for all veterinary expenses, transportation costs, medications, and related charges.

If immediate treatment is necessary and the Owner/Guardian cannot be reached, Owner/Guardian authorizes Pawsitively K9 to make reasonable decisions regarding emergency veterinary care in the best interest of the dog.

  1. PAYMENT AND CANCELLATION

All charges are due upon pickup unless other arrangements have been approved in writing.

A minimum of twenty-four (24) hours notice is required for cancellations.

Owner/Guardian remains responsible for all unpaid charges incurred during services.

  1. PHOTO AND VIDEO RELEASE

Owner/Guardian grants permission for Pawsitively K9 to use photographs or videos of the dog for promotional, educational, advertising, website, and social media purposes without compensation.

  1. ENTIRE AGREEMENT

This document represents the entire agreement between the parties and supersedes any prior discussions or understandings.

  1. ARBITRATION AND GOVERNING LAW

Any dispute arising from this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

The parties agree that Tennessee law shall govern this Agreement.

The parties understand that by signing this Agreement they are waiving their right to a jury trial and agreeing to resolve disputes through arbitration.

CONTINUING AGREEMENT
Owner/Guardian understands and agrees that this Service Agreement and Liability Waiver shall remain valid and enforceable for all future services provided by Pawsitively K9, including but not limited to boarding, daycare, board-and-train programs, transportation, training activities conducted during boarding or daycare, and any related services, unless superseded by a revised agreement.
Owner/Guardian agrees to notify Pawsitively K9 promptly of any changes to the dog’s health, vaccination status, behavior, bite history, ownership, contact information, emergency contacts, or other material information.
Owner/Guardian acknowledges that each time the dog is checked into Pawsitively K9, the Owner/Guardian is reaffirming the accuracy of the information previously provided and agreeing to the terms of this Agreement.
Pawsitively K9 reserves the right to require execution of a new agreement at any time.
